Terms and Conditions
FITNESS TO PARTICIPATE
1. The Participant acknowledges to FTP FIT that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant may choose to obtain a third party medical examination and clearance prior to participating in the Service.
WAVIER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY
2. The Participant understands by using any Service, Product, this website or communicating with FTP FIT is acceptance and release of any liability participating in any Service offered. The Participant may choose to or decline signing a Waiver or continue to use the Services offered by FTP FIT. Non-agreement to any terms will be honoured by the Participant's discontinuance of any and all Services offered.
2.2 The Participant acknowledges and agrees with FTP FIT that: (1) the Service Provider has given the Participant sufficient time to carefully read the Waiver, (2) the Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Participant fully understands the risks and claims that the Participant is waiving to participate in the Service, (4) the Participant is freely and voluntarily executing this Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against the Service Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for or post participating in the Service.
PAYMENT AND SERVICE FEES
3. The Participant will receive a Service invoice copy typically within 48 of the scheduled Service and all fees are subject to full payment before 14 days from the invoice date.
3.1. There will be no additional fees outside the Participants scheduled Service, for rescheduling or cancellation within the refund terms listed in Section 4. Refunds.
3.2. All prices are shown in AUD (Australian Dollars).
REFUNDS
4. Refunds for scheduled services will not be given in the event a Participant can not attend without valid exceptional reason. If a Participant can not attend and provide prior announcement of cancellation then the conditions of clause 4.2 will be employed.
4.1. A full refund is available for cancellation with more than 48 hours notice prior to the Participants scheduled Service. A cancellation less than 48 hours to the scheduled service will result in 20% of the Participants Service fee be charged to cover administration costs, cancellation processing and rescheduling. FTP FIT will honour any and all valid respectable reasons such as acquired injuries, sickness or illness, as well as, change of mind or other reasons a Participant may have.
4.2. At the discretion of FTP FIT, allowances maybe decided at the providers discretion to fully refund the Participant when less than 48 hours or no notice was given prior regarding the Service cancellation. This applies where advance payments are made or gift vouchers issued.
CONFIDENTIALITY
5. The Participant agrees that the services provided by FTP FIT are confidential and may not be disclosed to any third party without the consent of the Service provider, including but not limited to, the materials provided to me from FTP FIT, the techniques and methodologies used by FTP FIT and its staff in rendering services under this arrangement and the substance of the communications between FTP FIT and myself. That the Participant shall not reproduce any materials provided by FTP FIT. The Service Provider will not disclose any personal details of any Participant to another party unless required by law.
